UAE Employment Law: Employee Rights & Employer Obligations

Browse NowThe UAE rewrote its employment law in 2022. Every contract, termination rule, and leave entitlement changed — and most employees still operate under outdated assumptions from the 1980 law.
What Is UAE Employment Law?
UAE employment law is governed by Federal Decree-Law No. 33 of 2021, which replaced the 1980 Labour Law in February 2022. The new law abolished unlimited contracts (all contracts are now fixed-term, 3-year maximum), recognized new work models (part-time, freelance, flexible), introduced explicit anti-discrimination provisions, and established a framework for federal minimum wage. It applies to all private-sector employees in the UAE including free zone workers, with exceptions for domestic workers, government employees, and DIFC/ADGM employees.
The 2022 overhaul was not incremental. It restructured fundamental employment concepts:
| Change | Old Law (1980) | New Law (2022) |
|---|---|---|
| Contract types | Unlimited and fixed-term | Fixed-term only (3-year max) |
| Work models | Traditional employment only | Part-time, temporary, freelance, flexible |
| Discrimination protections | Not explicitly addressed | Race, gender, religion, nationality, disability, social origin |
| Non-compete clauses | Broadly enforceable | Limited to 2 years maximum, proportionality required |
| Final settlement deadline | Not specified | 14 days |
| Minimum wage | No framework | Federal framework established |
Existing unlimited contracts had to be converted to fixed-term by February 2023.

What Rights Do Employees Have Under the New Law?
Employees are entitled to 8-hour workdays (reduced by 2 hours during Ramadan), overtime at 125–150% of base rate, 30 days annual leave after one year, 90 days sick leave (tiered pay), 60 days maternity leave, 5 days paternity leave, end-of-service gratuity after one year (21 days per year for first 5 years, 30 days per year thereafter, capped at 2 years' salary), and wage protection through the mandatory WPS electronic payment system.
Working Hours and Overtime
Standard: 8 hours per day or 48 hours per week. During Ramadan, reduced by 2 hours for all employees regardless of religion.
Overtime caps at 2 hours per day:
| Overtime Period | Compensation |
|---|---|
| Standard overtime | Base hourly rate + 25% |
| Night overtime (10 PM–4 AM) | Base hourly rate + 50% |
| Shift workers (night) | Standard rate (no premium) |
Leave Entitlements
| Leave Type | Entitlement | Pay |
|---|---|---|
| Annual leave | 30 days/year (after 1 year), 2 days/month (6–12 months) | Full pay |
| Sick leave | 90 days/year | 15 days full, 30 days half, 45 days unpaid |
| Maternity | 60 days | 45 days full, 15 days half (+45 unpaid for medical reasons) |
| Paternity | 5 working days | Full pay (within 6 months of birth) |
| Bereavement | 5 days (spouse), 3 days (parent, child, sibling) | Full pay |
| Study leave | 10 days/year (2+ years service, UAE institution) | Full pay |
Wage Protection
All employers must pay through the Wage Protection System (WPS), an electronic salary transfer monitored by MOHRE. Late payment gives employees grounds to file a complaint.
End-of-Service Gratuity
| Service Duration | Gratuity Calculation |
|---|---|
| 1–5 years | 21 calendar days' basic salary per year |
| Beyond 5 years | 30 calendar days' basic salary per year |
| Maximum cap | 2 years' total basic salary |
Gratuity is calculated on last basic salary — excluding allowances, bonuses, and commissions. Minimum one year of continuous service required.
What Are Employer Obligations Under the New Law?
Employers must provide written Arabic employment contracts specifying all material terms, pay through WPS, maintain occupational health and safety standards (including the midday summer work ban from 12:30–3:00 PM, June 15 to September 15), settle all dues within 14 days of employment ending, and comply with anti-discrimination provisions. Non-compete clauses are enforceable but limited to 2 years maximum and must be proportionate to role, geography, and nature of work.
Employment Contracts
Every employer must provide a written contract in Arabic (bilingual copies common) specifying:
- Job title, start date, workplace
- Working hours, salary, leave entitlements
- Notice period, contract duration
Health and Safety
Employers must provide a safe working environment including occupational health measures, PPE, and hazard assessments. Outdoor work is prohibited during peak summer heat: 12:30 PM to 3:00 PM, June 15 to September 15.
Non-Compete Clauses
Enforceable but subject to limits:
- Maximum 2 years duration
- Must be proportionate to employee's role, geographic area, and nature of work
- Unreasonable restrictions can be struck down by courts
Final Settlement
All dues — gratuity, unused leave, final salary — must be settled within 14 days of employment ending.

How Do Termination Rules Work?
Either party can terminate a fixed-term contract with 30–90 days written notice as specified in the contract. Employers can terminate without notice for specific causes (repeated poor performance after warnings, serious misconduct, safety violations, extended unauthorized absence). Arbitrary dismissal — termination that is retaliatory or without valid reason — entitles the employee to compensation of up to 3 months' salary in addition to gratuity and notice period pay.
Notice Period
Minimum 30 days, maximum 90 days, as specified in the contract. During the notice period, employees get one unpaid day per week for job searching.
Lawful Termination by Employer (No Notice)
Article 44 grounds include:
- Repeated poor performance after written warnings
- Serious misconduct
- Violation of safety rules
- Absence exceeding 20 non-consecutive days or 7 consecutive days without justification
Arbitrary Dismissal
If a court finds termination was arbitrary (retaliatory, without valid reason), the employee receives:
- Up to 3 months' salary as compensation
- Plus gratuity entitlement
- Plus notice period pay
Employee Resignation
Employees resign by providing the contractual notice period. Failing to serve notice may require compensation equal to notice period salary.
How Does the MOHRE Dispute Resolution Process Work?
Employment disputes follow a three-stage process: (1) file a complaint through the MOHRE smart app or website, (2) attend mandatory mediation at MOHRE within 14 days where a mediator attempts settlement, and (3) if mediation fails, the case is automatically referred to the labor court within the relevant emirate. MOHRE mediation is free, and most wage and gratuity disputes are resolved at this stage without court proceedings.
| Stage | Timeline | Cost | Outcome |
|---|---|---|---|
| MOHRE complaint filing | 1–3 days | Free | Case opened, employer notified |
| MOHRE mediation | Within 14 days of filing | Free | Settlement or referral to court |
| Labor court | 2–6 months | Court fees apply | Binding judgment |
| Appeal (if filed) | 3–6 months | Additional court fees | Final judgment |
The MOHRE mediation stage resolves the majority of straightforward wage and gratuity disputes. Mediators have authority to propose settlements and often achieve results within a single session. Employers who fail to attend mediation or refuse reasonable settlement offers face unfavorable treatment at the court stage.
If mediation fails, MOHRE automatically refers the case to the labor court. At this point, professional legal representation becomes significantly more important — labor court proceedings follow formal procedural rules, require Arabic-language filings, and involve evidence presentation standards that are difficult to navigate without a lawyer.
Employees can file MOHRE complaints while still employed — the law protects against retaliatory termination for filing a legitimate complaint.
What Are the Most Common Employment Disputes?
The five most frequent disputes handled by MOHRE and UAE labor courts are: unpaid or delayed wages (file through MOHRE app), arbitrary termination claims (compensation through labor court), end-of-service gratuity calculation disagreements (what constitutes "basic salary"), non-compete enforcement by former employers, and workplace discrimination or harassment under the new anti-discrimination provisions.
| Dispute Type | Resolution Path | Typical Outcome |
|---|---|---|
| Unpaid/delayed wages | MOHRE complaint → mediation → labor court | Salary recovery + potential fines on employer |
| Arbitrary termination | Labor court | Up to 3 months' salary compensation |
| Gratuity calculation | MOHRE mediation → labor court | Correct calculation based on basic salary |
| Non-compete enforcement | Civil court (employer files) | Injunction or dismissal based on proportionality |
| Discrimination/harassment | MOHRE complaint → labor court | Compensation, potential employer penalties |

When Should You Hire a Labor Lawyer?
MOHRE offers free dispute resolution, but a lawyer is recommended when facing termination you believe is arbitrary or retaliatory, when your employer withholds gratuity or final settlement, when you need to review or negotiate an employment contract or non-compete clause, when your case escalates from MOHRE mediation to labor court, and when you are an employer handling complex HR matters or mass redundancy.
Hire a labor lawyer when:
- Facing termination that may be arbitrary or retaliatory
- Employer has withheld gratuity or final settlement
- Reviewing or negotiating a contract or non-compete clause
- Case has escalated from MOHRE mediation to labor court
- You are an employer handling complex HR or mass redundancy
MOHRE mediation is free and resolves many disputes. But when mediation fails and the case moves to court, professional representation becomes critical.

Frequently Asked Questions
Can your employer change your salary or job role without consent?
No. Any material change to the employment contract — salary reduction, role change, relocation — requires written employee consent. Unilateral changes are breach of contract and grounds for a MOHRE complaint.
What happens if your employer does not pay through WPS?
File a complaint with MOHRE through their app or website. MOHRE actively monitors WPS compliance and imposes fines on non-compliant employers. Your complaint triggers investigation and mediation.
Are you entitled to gratuity if you resign before one year?
No. End-of-service gratuity requires minimum one year of continuous service. However, employees with 6+ months of service are entitled to pro-rated annual leave payment.
Can you work for another employer during your notice period?
You get one unpaid day per week for job searching. Taking up new employment before your notice period ends — without employer consent — could breach your non-compete clause if one exists.
Does UAE employment law apply to free zone employees?
Yes. Federal Decree-Law No. 33 of 2021 covers all UAE employees including free zone workers. Exceptions: domestic workers, federal/local government employees, and DIFC/ADGM employees (who operate under separate employment regulations).
